Abstract:
Traditional knowledge has been used for centuries by indigenous peoples and local communities
under their local laws, customs and traditions. It is transmitted and evolved from generation to
generation. However, due to globalization themisappropriation andbio piracy affectits
preservation and protection.The main objectives of this study were to over view the international
and regionally the existing laws and the Ethiopian legal framework context on its mechanisms to
protect TK. In order to reach at the stated objectives, qualitative data collection method by
preparing questions for the study used.It draws on the narratives of interviews and
questionnaires made to Ethiopian Intellectual Property Authority and Institute of Biodiversity
conservations. The study argues that the current legislation governing TK in Ethiopia demands
amendments, direct and full incorporation of the African Regional model law in to the domestic
laws.Thus, this study also concludes as Ethiopia has to apply the International and regional
human rights system,amend its current legislation and allocate budget for Institute of
Biodiversity on collection of TK available in different areas in order to realize this right. So,
struggle for better approach and finalize the protection regime by enacting laws and adapting
the protection tool of the advanced country experience is needed. The national laws and
practicesof Ethiopia towards protection of traditional knowledge is no far from international
law. This paper analysis the traditional knowledge protection system and observe and take the
experienced country which can be lesson for Ethiopia.Therefore, by over viewing the existing
laws and the practices in Ethiopia on the protection of traditional knowledge, this study
forwards the conclusion and recommendations.
